Deep Creek Highland Property Owners Association is not involved in the internal management of the Overlook Cabins. The understanding is they are private/personal real estate and not part of the common area of the Deep Creek Highlands. The lots are Class 1,2 or 3 and are subjected the Governing Documents of the Deep Creek Highlands Property Owners Association and the Deep Creek Mountain Resort Property Owners Association (Documents posted on www.dchighlands.com). The Declarant, pursuant to the Declaration, is exempt from paying assessment on Cabin Lots until the Cabin is occupied or the Declarant is no longer the owner. During the Bankruptcy of DC Development, 2013, Western Union Bank (WUB) bought the Cabin Lots that were
still owned by the Declarant and became the new Declarant. When WUB sells a Cabin Lot, the new owner is subject to the uniform assessment of whatever Class the Cabin Lot is titled in the Deed. The maintenance of the private real estate of the Overlook Cabins, with respect to snow removal and lawn care, is not managed by the Deep Creek Highlands Association. Land Records of Garrett County has the recorded "Maintenance"
. The Governing Documents of the Association do not give power or authorization to the Deep Creek Highlands Association to manage or collect funds for private/personal property of Class 1,2 or 3 Members.
There are three building Design Plans permitted to be constructed on the Cabin Lots. The Design plans required per lot are on the Plat below. The Cabin Lots are subjected to The Architectural Guidelines and require approval from the Architectural Committee prior to construction or changes to the property.
